This three hour seminar will cover the topics of debt collection, bankruptcy and the Ohio Receivership Law.

Judge Patrick Carroll will present on Default Judgements.This presentation includes the procedural steps to obtaining and maintaining a default judgment by a plaintiff.  The seminar includes the application of Civil Rule 55 in civil actions. This also includes issues of personal and subject matter jurisdiction, capacity of defendant, appearance by defendant, time limitations, military affidavits, and calculation of damages, including limitation and hearing on damages. Civ. R.8(D). Including post judgment motions, issues of relief from judgment by Civil Rule 60 and void and voidable judgments as well as collection/enforcement of judgment. Other issues include default judgment and/or dismissals as sanctions for noncompliance with discovery or other court orders.  Other related civil procedural issues include comparison with judgment on the pleadings, summary judgment, ex parte trials, leave to plead, and attachment top leadings.  

Colette Gibbons and Scott Opincar will review recent amendments to Ohio’s receivership law and discuss significant appellate cases decided under those amendments.

Julie Rabin will be speaking on Chapter 7 and Chapter 13, the two bankruptcy options used most widely by individuals seeking relief from financial distress.
